Terms of Service

Welcome to Ordesify. By accessing ordesify.com or any related service (the “Service”), you agree to these Terms (“Agreement”). Please read them carefully.

1. Acceptance of Terms

By signing up, signing in, or otherwise using the Service, you accept this Agreement and our Privacy Policy. If you do not agree, please stop using the Service.

2. Description of the Service

Ordesify is a Software-as-a-Service platform for restaurants. It includes:

• An online menu system and QR-code ordering
• Order management for kitchen and service staff
• Payment processing through a third-party provider (Omise)
• Promotions, coupons, and sales reporting
• Income and expense accounting (subject to plan)
• A recipe community

We may add, remove, or change features at any time to improve the service.

3. Account Registration

3.1 General

• You must be at least 20 years old, or have parental consent.
• Information you submit must be accurate and current.
• You are responsible for safeguarding your password and account.
• Notify us immediately if you become aware of any unauthorized access.

3.2 Social Login

If you sign in with Google, Facebook, or LINE, you authorize us to access your email and name from that account, as described in our Privacy Policy.

4. Plans and Payments

4.1 Plans

We offer Free, Pro, and Premium plans with different features and limits. The current details are on our pricing page.

4.2 Billing

• Fees are charged monthly or annually, based on the cycle you choose.
• Payments are processed through Omise. We do not store your payment details.
• If a payment fails, we may suspend access to paid features.

4.3 Refunds

Fees already paid are non-refundable, except where required by law or where we have caused an extended technical outage that prevents you from using the service.

4.4 Cancellation

You can cancel your plan at any time. Cancellation takes effect at the end of the current billing cycle. Features remain available through that date.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or deceptive purposes
• Post content that infringes copyright, trademarks, or other rights
• Post obscene, offensive, or harmful content, or content harmful to children
• Send spam, malware, or harmful files
• Attempt to break security, disrupt the Service, or access data of other users without authorization
• Use the Service in a way that violates the terms of our providers (Google, Facebook, LINE, Omise)
• Resell, sublicense, or commercially reproduce the Service without prior written consent

We reserve the right to suspend or terminate accounts that violate these rules.

6. Restaurant Owner Responsibilities

If you are a restaurant owner using the platform, you are responsible for:

• The accuracy of your menu, prices, and descriptions
• Compliance with food, public-health, and tax law
• Customer service and dispute resolution for orders placed at your restaurant
• Refunds and compensation according to your restaurant’s policy
• The accuracy of nutrition data you provide
• Obtaining the rights for any photos and content you upload

Ordesify is a platform provider, not a food seller, and is not responsible for the quality or safety of food sold through the system.

7. Recipe Community

Content you post in the recipe community remains yours. By posting, you grant Ordesify the right to:

• Display your content on the platform
• Promote approved recipes as menu templates available to other restaurants
• Resize or compress images for display

We reserve the right to remove content that violates Section 5 without prior notice.

8. Intellectual Property

• Ordesify’s code, design, logo, and trademarks are owned by us or our licensors.
• Content you upload (menus, photos, recipes) remains yours. You grant us a limited license to display and process it as needed to provide the service.
• You may not copy, modify, or reverse-engineer our software.

9. Termination and Suspension

9.1 By you

You may delete your account at any time through your settings or by contacting us.

9.2 By us

We may suspend or terminate your account if:

• You violate Section 5
• Your payment fails repeatedly
• We’re required to by legal process
• The account has been inactive for an extended period (more than 12 months on Free plans)

If termination is due to a violation, no refund is owed.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted or always available
• The Service is free of errors or bugs
• The Service will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by law, Ordesify is not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, revenue, data, or business opportunities
• Force majeure events such as natural disasters, war, or cyberattacks
• Issues caused by third-party providers (Omise, Google, Facebook, LINE, hosting providers)

Our total liability in any case will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to defend and indemnify Ordesify against third-party claims arising from:

• Your use of the Service
• Your breach of this Agreement
• Your violation of another party’s rights
• Content you post or data you upload

13. Governing Law

This Agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with this Agreement shall be subject to the jurisdiction of the courts of Thailand.

14. Changes to These Terms

We may update this Agreement from time to time. For material changes, we’ll give advance notice via email or a notice on the website. Continued use of the Service after changes take effect means you accept the updated Terms.
